1. Acceptance of Terms
By accessing or using the Konsensus e-meeting platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.
2. Platform Purpose
Konsensus provides a digital platform for sectional title schemes, homeowners associations, and voluntary associations to conduct electronic meetings, manage voting, and facilitate community governance in compliance with applicable legislation.
3. Access and Security
Your meeting access link is unique to you and must not be shared with any other person. Each link is tied to your specific unit and voting entitlement. Unauthorised sharing of access links may affect the validity of meeting proceedings.
4. Voting and Proxies
Votes cast through the platform are recorded as your official vote on the respective resolution. Proxy appointments must be submitted before the meeting opens for voting. You may appoint a maximum of two (2) proxies in accordance with the Prescribed Management Rules.
5. Acceptable Use
You agree not to:
- Attempt to access another participant's account or data
- Interfere with or disrupt the platform's operation
- Use the platform for any unlawful purpose
- Submit false information or impersonate another person
6. Intellectual Property
The Konsensus platform, including its software, design, and content, is owned by NEM Novel e-Meeting Services. You may not copy, modify, or distribute any part of the platform without written permission.
7. Limitation of Liability
Konsensus is provided "as is". We are not liable for any indirect or consequential damages arising from your use of the platform, including any disruption to meeting proceedings due to connectivity or technical issues beyond our reasonable control.
8. Changes to Terms
We may update these Terms from time to time. Continued use of the platform after changes are published constitutes acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
